Welcome to Kitchen Pro Solutions.

These Terms & Conditions explain how we handle quotes, orders, payments, delivery, returns, warranties and other matters when you purchase commercial kitchen equipment from us.

We aim to make the purchasing process as straightforward as possible. If you have any questions about these Terms & Conditions or a particular product, please contact us before placing your order and we will be happy to assist.

By placing an order with Kitchen Pro Solutions, you acknowledge that you have read and accepted these Terms & Conditions.

1. About Kitchen Pro Solutions

1.1 Kitchen Pro Solutions (ABN 62 559 153 547) is a Melbourne-based online supplier of commercial kitchen equipment.

1.2 We supply commercial kitchen equipment Australia-wide, including refrigeration, cooking equipment, dishwashing equipment, preparation equipment and related products.

1.3 Kitchen Pro Solutions may source products from manufacturers, distributors and other authorised suppliers.

1.4 These Terms & Conditions apply to purchases made through our website, quotations, invoices and other sales channels unless otherwise agreed in writing.

1.5 These Terms & Conditions are governed by the laws of Victoria, Australia.

1.6 Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

2. Quotes, Pricing & Product Availability

2.1 Unless otherwise stated, quotations are valid for 30 days from the date of issue.

2.2 Quoted prices include GST unless expressly stated otherwise. Delivery, installation and other additional services are excluded unless specifically included in the quotation.

2.3 Prices and availability may change due to manufacturer price changes, supplier availability, freight costs, exchange rate movements or other circumstances outside our reasonable control.

2.4 Where a quotation has been accepted and payment has been received, the quoted product price will generally be honoured unless there has been an obvious pricing error or the product becomes unavailable for reasons outside our reasonable control.

2.5 Product availability is subject to confirmation with the relevant manufacturer or supplier. Stock displayed as available on our website may be subject to change.

2.6 We make reasonable efforts to ensure pricing and product information is accurate. If an obvious error is identified before an order is accepted, we will contact the customer to discuss the correct price or available alternatives.

2.7 Unless otherwise agreed in writing, a quotation does not constitute an acceptance of an order or confirmation that stock has been reserved.

3. Orders & Order Acceptance

3.1 Customers are responsible for providing accurate and complete information when placing an order, including contact details, delivery address, product requirements and any relevant site or access information.

3.2 An order is accepted when Kitchen Pro Solutions confirms the order in writing, issues an invoice, or otherwise confirms that the order is being processed.

3.3 We reserve the right to decline or cancel an order where:

  • a product is unavailable or discontinued;
  • a manufacturer or supplier is unable to fulfil the order;
  • an obvious pricing or product description error has occurred;
  • the requested product is no longer available;
  • circumstances outside our reasonable control prevent supply; or
  • other reasonable grounds prevent us from fulfilling the order.

3.4 If Kitchen Pro Solutions is unable to fulfil an order after payment has been received, we will contact the customer and arrange an appropriate refund or alternative solution.

3.5 Customers should carefully check product specifications, dimensions, capacities, configuration and intended application before placing an order. We are happy to assist with product information and recommendations where requested.

4. Invoicing & Payment

4.1 Kitchen Pro Solutions generally issues invoices electronically, including through Xero, to the email address provided by the customer.

4.2 Unless otherwise agreed in writing, invoices are issued with payment due within 7 days of the invoice date.

4.3 The 7-day invoice period is the payment due date and does not constitute a credit facility or an agreement to supply or dispatch goods before payment has been received.

4.4 Payment in full is required before products are ordered from suppliers, dispatched or released for delivery, unless otherwise agreed in writing by Kitchen Pro Solutions.

4.5 An order will not be scheduled for delivery or dispatch until payment has been received in full and cleared funds are available.

4.6 Where a customer requires a product to be specially ordered, allocated or reserved before payment, this must be agreed with Kitchen Pro Solutions in writing.

4.7 Accepted payment methods may include bank transfer and credit card. Applicable credit card or payment processing fees will be advised where relevant.

4.8 Customers should retain their invoice and payment confirmation as proof of purchase.

4.9 Where an invoice remains unpaid after its due date, Kitchen Pro Solutions may delay procurement, dispatch or delivery until payment has been received.

4.10 Nothing in this section limits any rights either party may have under applicable law.

5. Cancellations

5.1 Customers may request cancellation of an order by contacting Kitchen Pro Solutions as soon as possible.

5.2 Where an order has not yet been processed with a manufacturer or supplier, we will endeavour to accommodate cancellation requests.

5.3 Where a product has already been ordered from a manufacturer or supplier, specially manufactured, customised, allocated, dispatched or otherwise committed to by Kitchen Pro Solutions, cancellation may be subject to applicable supplier charges, restocking charges, freight costs and other reasonable costs incurred in connection with the order.

5.4 Any applicable cancellation or restocking charges will be advised to the customer where reasonably practicable before a cancellation is processed.

5.5 Custom-made, specially manufactured, customised or non-stock products may not be eligible for cancellation or return where the supplier is unable to accept cancellation.

5.6 This section does not affect any rights or remedies available to the customer under the Australian Consumer Law.

6. Returns & Change of Mind

  • 6.1 Kitchen Pro Solutions does not generally accept returns for change of mind where a product has been correctly supplied and is not faulty, defective or otherwise covered by a consumer guarantee.

    6.2 Where we agree to accept a change-of-mind or customer-requested return, the return may be subject to:

    • the manufacturer's or distributor's return conditions;
    • applicable restocking charges;
    • return freight costs; and
    • any reasonable costs incurred in arranging the return.

    6.3 Any applicable charges will be discussed with the customer before the return is authorised.

    6.4 Products must generally be unused, undamaged and in their original packaging where a discretionary return has been approved.

    6.5 Custom-made, specially ordered, customised or non-stock products may not be eligible for return unless otherwise agreed in writing.

    6.6 Nothing in this section limits or excludes any rights or remedies available under the Australian Consumer Law.

7. Australian Consumer Law

7.1 Kitchen Pro Solutions recognises and complies with the rights and guarantees provided under the Australian Consumer Law.

7.2 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

7.3 You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

7.4 You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7.5 The rights available under the Australian Consumer Law may apply differently depending on the nature of the customer, the product and the purpose for which the product is purchased.

7.6 Nothing in these Terms & Conditions is intended to limit or exclude any consumer guarantee, right or remedy that cannot lawfully be limited or excluded.

8. Delivery & Shipping

8.1 Kitchen Pro Solutions supplies products Australia-wide using freight and courier providers selected according to the product, destination and delivery requirements.

8.2 Delivery timeframes provided by Kitchen Pro Solutions are estimates only. Actual delivery times may vary depending on product availability, supplier processing times, freight schedules, destination and circumstances outside our reasonable control.

8.3 Unless otherwise stated, standard delivery is kerbside delivery during normal business hours, Monday to Friday.

8.4 Standard kerbside delivery does not generally include carrying goods inside a premises, negotiating stairs, lifting equipment into position, unpacking equipment, removing packaging or removing existing equipment.

8.5 Delivery drivers may assist with unloading where they consider it reasonably safe and practical to do so, but are not required to negotiate stairs, difficult accessways or other hazardous or restricted areas.

8.6 Customers requiring specialist delivery services, including delivery inside premises, shopping centre deliveries, stair access, tailgate or specialised lifting services, unpacking or removal of existing equipment should advise us before delivery. Additional charges may apply.

8.7 Customers are responsible for notifying Kitchen Pro Solutions of any relevant delivery restrictions or access requirements, including:

  • stairs;
  • narrow doorways or accessways;
  • loading dock restrictions;
  • height or weight restrictions;
  • shopping centre delivery requirements;
  • restricted delivery hours;
  • lack of suitable unloading facilities; and
  • other site conditions that may affect delivery.

8.8 Where additional delivery requirements or site conditions were not disclosed before dispatch, additional freight or delivery charges may apply.

8.9 Customers should ensure that someone authorised to receive the goods is available at the delivery address during the agreed delivery window.

8.10 Where a delivery cannot be completed due to circumstances attributable to the customer, including incorrect delivery information, refusal of delivery or unsuitable access, additional delivery or redelivery charges may apply.

8.11 We will make reasonable efforts to assist customers where freight delays, damage or other delivery issues occur.

9. Delivery Damage

9.1 We take reasonable care to ensure products are appropriately packaged and dispatched through reputable freight providers.

9.2 Customers should inspect products and packaging as soon as reasonably practicable after delivery.

9.3 Where visible damage is identified, customers should notify Kitchen Pro Solutions as soon as reasonably practicable and, where possible, provide photographs of the packaging and damaged product.

9.4 Where significant damage is identified at the time of delivery, customers should notify the driver and, where appropriate, note the damage on the delivery documentation or decline the delivery.

9.5 If goods are damaged in transit, Kitchen Pro Solutions will work with the customer and the relevant freight provider, manufacturer or supplier to determine an appropriate resolution.

9.6 Depending on the circumstances and the nature of the damage, the appropriate resolution may include repair, replacement parts, replacement of the product or another remedy.

9.7 Customers are encouraged to retain original packaging until the product has been inspected and confirmed to be in satisfactory condition.

9.8 Nothing in this section limits or excludes any rights or remedies available under the Australian Consumer Law.

10. Installation & Site Requirements

10.1 Unless specifically stated in a quotation, product prices do not include building work, site preparation or installation services.

10.2 Unless specifically included in writing, customers are responsible for arranging any required:

  • electrical connections and suitable power points;
  • plumbing connections;
  • water supply and filtration;
  • drainage;
  • gas connections;
  • ventilation or exhaust systems;
  • building or structural work;
  • flooring or levelling;
  • commissioning; and
  • other site preparation required for installation.

10.3 Gas, electrical and plumbing work should be carried out by appropriately licensed and qualified tradespeople.

10.4 Customers are responsible for ensuring that the installation site and associated services are suitable for the equipment and comply with applicable laws, regulations, standards and manufacturer requirements.

10.5 Where Kitchen Pro Solutions provides product recommendations based on information supplied by the customer, the customer remains responsible for confirming that the proposed equipment is suitable for the specific site and application unless a separate design or installation service has been agreed in writing.

10.6 Customers should contact us before ordering if they require assistance confirming dimensions, access, utilities or installation requirements.

11. Manufacturer Warranties

11.1 Many products supplied by Kitchen Pro Solutions are covered by a manufacturer's warranty. Warranty periods, inclusions and exclusions vary between products and manufacturers.

11.2 Where applicable, warranty information will be provided with the product, quotation, product documentation or through the relevant manufacturer's warranty terms.

11.3 Manufacturer warranties are additional to, and do not replace or limit, any rights or remedies available to customers under the Australian Consumer Law.

11.4 Depending on the manufacturer and product, warranty claims may be handled directly by the manufacturer or its authorised service agent. Kitchen Pro Solutions will assist customers with the warranty process where reasonably required.

11.5 Manufacturer warranty claims may require proof of purchase, including a Kitchen Pro Solutions tax invoice or delivery documentation.

11.6 Certain products, particularly gas appliances, may require evidence of installation by an appropriately licensed person or a relevant certificate of compliance.

11.7 Where a manufacturer requires an inspection to determine whether a fault is covered by its manufacturer's warranty, inspection fees or service charges may apply where the manufacturer determines that the issue is not covered by its warranty terms.

11.8 Some manufacturers provide back-to-base warranties. Where this applies, the manufacturer's warranty terms may require the customer to arrange or pay for transport of the product to the nominated service centre.

11.9 Manufacturer warranty terms may exclude matters such as damage caused by misuse, incorrect installation, unauthorised modification, accidental damage, inadequate maintenance or use contrary to manufacturer instructions. The applicable manufacturer's warranty terms should be reviewed for specific details.

11.10 Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

12. Product Information & Specifications

12.1 We make reasonable efforts to ensure product descriptions, images, dimensions, specifications and availability information published on our website are accurate and up to date.

12.2 Manufacturers may occasionally update product specifications, finishes, features, dimensions, images or other product information without notice.

12.3 Where there is a material change to a product that has been ordered but not yet supplied, Kitchen Pro Solutions will notify the customer where reasonably practicable.

12.4 Customers requiring confirmation of a particular specification, dimension, configuration, finish or feature should contact us before placing an order.

12.5 Product images may occasionally depict accessories, optional equipment or configurations that are not included in the standard product price. The applicable quotation or product description should be reviewed to confirm what is included.

12.6 Product colours and finishes may appear differently depending on the customer's display or device.

13. Customer Responsibilities

13.1 Customers are responsible for providing accurate information regarding the intended use, location, dimensions and requirements of the equipment being purchased.

13.2 Customers should ensure that equipment is used, installed, cleaned and maintained in accordance with the applicable manufacturer's instructions.

13.3 Customers are responsible for obtaining any licences, approvals, certificates or permits required for the installation or operation of equipment at their premises, unless otherwise agreed in writing.

13.4 Customers should not modify, repair or alter equipment in a manner contrary to manufacturer instructions or applicable laws and standards.

14. Limitation of Liability

14.1 To the extent permitted by law, Kitchen Pro Solutions will not be responsible for loss or damage caused by circumstances outside our reasonable control.

14.2 To the extent permitted by law, we are not responsible for damage resulting from misuse, unauthorised modification, incorrect installation, failure to follow manufacturer instructions or other circumstances attributable to the customer or a third party.

14.3 We are not responsible for delays or failures caused by circumstances outside our reasonable control, including manufacturer delays, supplier delays, freight delays, extreme weather, natural disasters, industrial disputes, transport disruptions, government restrictions or other events beyond our reasonable control.

14.4 Nothing in these Terms & Conditions excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded or limited under the Australian Consumer Law.

15. In Person Consultations

15.1 Kitchen Pro Solutions operates primarily as an online business and is available for in-person consultations by appointment in Melbourne and surrounding areas.

15.2 Consultation appointments are subject to availability and must be arranged in advance.

15.3 Unless otherwise agreed in writing, an in-person consultation does not constitute a formal design, engineering, certification, installation or building service.

16. Privacy

16.1 Kitchen Pro Solutions is committed to protecting personal information in accordance with applicable privacy laws and our Privacy Policy.

16.2 Personal information provided to us may be used for purposes including processing orders, issuing invoices, arranging delivery, communicating with customers, providing product support and handling warranty matters.

17. Changes to These Terms & Conditions

17.1 Kitchen Pro Solutions may update these Terms & Conditions from time to time.

17.2 Updated Terms & Conditions will be published on our website with an updated effective date.

17.3 The Terms & Conditions applicable to an order will generally be those in effect at the time the order is accepted, unless otherwise agreed in writing or required by law.
